Golfer Tiger Woods — Could His Auto Collision (and the "Media Circus") Have Been Avoided? ...Tips for Avoiding DUI and Motor Vehicle Violations During the Holiday Season.

By Michael L. Pescatore, Esq.

As you may have seen in the media, the world's top golfer, Tiger Woods, was involved in an automobile collision close to home near Orlando, Florida. Undoubtedly, Mr. Woods will now face intense media scrutiny, questions from the police and other problems which will cost him time, expense, great inconvenience and inflict undue stress upon  himself and his family.

In reality, this can happen to anyone behind the wheel... so how do you avoid this type of problem?

Motor vehicle problems are more common during the holiday season because of the greater number of office and family parties and other celebrations which lead to a higher consumption of alcohol and, generally, more careless behavior.

Therefore, using certain "tips" can help to reduce the chances of a DUI conviction and reduce the chances of a DUI arrest. Specifically —

1. If you drink, do not drive. As an alternative, you must strictly limit your alcohol intake and monitor the time over which the intake occurs (For example, one drink at a party over a three-hour period). This will increase the chances of passing a Breathalyzer® test in the event of a pullover. A designated driver is a better idea.

2. Know your community and become aware of where local police tend to set up driver checkpoints for sobriety tests and vehicle inspections, especially during the holidays (but also all year around). When in doubt, sleep in your car or call someone to pick you up — it's better than being pulled over with the likelihood that you are legally intoxicated.

3. If you are arrested for a DUI, be aware that if you refuse to take a breath test, this is also a serious situation and can, like a DUI conviction, result in a license loss.

4. Be aware that, legally, having open containers of alcohol in your vehicle while driving is a serious offense — whether you were drinking or not.

5. If you are arrested for a DUI, be aware that this (and many other traffic offenses) is very serious and could affect the lives of you and your family. Hire a DUI lawyer in Essex County, NJ to help you with your case!
